1. Scope of This Notice
This notice applies solely to residents of the State of California (“Consumers” or “you”) and supplements BlackGentry’s Privacy Policy. It is provided in accordance with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, the “CCPA”).
This notice describes:

- The purposes for which we use personal information
- The categories of third parties to whom personal information may be disclosed
- Your rights under California law and how to exercise them

We collect personal information from the following sources:
- Directly from you when you create an account or use the BlackGentry service
- Automatically from your device or your interactions with the service
- From service providers that assist us in operating, securing, and improving the platform

We use personal information for the following business purposes:
- Providing, operating, and maintaining the BlackGentry service
- Account creation, authentication, and profile management
- Facilitating matching and communications between users
- Enabling proximity-based features using precise geolocation data
- Customer support, safety, and enforcement
- Security, fraud prevention, and abuse detection
- Analytics and service improvement
- Compliance with legal obligations
5. Use of Sensitive Personal Information
BlackGentry collects and uses certain sensitive personal information, including precise geolocation data, solely as reasonably necessary to provide the BlackGentry service and related features.
We do not use sensitive personal information for purposes that require a consumer to exercise a right to limit use under the CPRA.
6. Sale or Sharing of Personal Information
BlackGentry does not sell personal information for monetary consideration.
However, California law defines “sale” and “sharing” broadly. As a result, certain disclosures of personal information to third parties for purposes such as analytics, security, or advertising measurement — including disclosures made in connection with our website through cookies or similar technologies — may be considered a “sale” or “sharing” of personal information under California law, even though BlackGentry does not exchange personal information for money and does not engage in traditional data brokerage activities.
7. Your Right to Opt Out of Sale or Sharing
California residents have the right to opt out of the sale or sharing of personal information.
You may exercise this right by contacting us using the methods described in Section 12 below. Where applicable, we will honor valid opt-out requests and signals in accordance with California law.
8. Retention of Personal Information
BlackGentry retains personal information for as long as reasonably necessary to:
- Provide and maintain the service
- Comply with legal and regulatory obligations
- Resolve disputes
- Enforce agreements
- Maintain records for security, fraud prevention, and legal compliance
When an account is deleted, personal information is removed, anonymized, or retained in a limited, de-identified or hashed form only as required for legal, security, or compliance purposes.
Safety and Security Retention
- Up to 3 months after voluntary account closure
- Up to 5 years if the account was terminated for violation of terms, safety incidents, or abuse
Legal and Compliance Retention
- Transaction and payment information: Up to 10 years for tax and accounting compliance
- Technical and traffic logs: Up to 2 years to support security, analytics, and legal retention requirements
- Records of consents: Up to 5 years to demonstrate compliance with applicable law
Legitimate Interest Retention
- Customer support records: Up to 5 years
- Profile information: Up to 1 year when necessary for legal, safety, or dispute resolution purposes
- Data to prevent re-registration of banned users: For as long as necessary to ensure safety and platform integrity
Legal Holds and Outstanding Issues
If there is an active investigation, legal claim, subpoena, or dispute requiring preservation, we may retain personal information beyond the periods described above as necessary to comply with legal obligations and participate in legal proceedings.
De-Identified and Aggregated Data
Where legally permitted, BlackGentry may retain and use data that has been de-identified or aggregated so that it cannot reasonably be used to identify you. Such data may be used indefinitely for analytics, research, service improvement, and safety purposes.
9. Your California Privacy Rights
- Right to Know: Request information about the categories and specific pieces of personal information collected about you
- Right to Delete: Request deletion of personal information collected from you
- Right to Correct: Request correction of inaccurate personal information
- Right to Limit Use of Sensitive Personal Information: Where applicable under California law
- Right to Non-Discrimination: You will not be discriminated against for exercising your privacy rights
10. Verification of Requests
To protect your privacy, we may need to verify your identity before responding to certain requests. Verification methods may vary depending on the request and the sensitivity of the information involved.
11. Authorized Agents
You may designate an authorized agent to submit a request on your behalf. We may require proof that the agent is authorized to act on your behalf and may also require you to verify your identity directly.
